The Stages of a DWI/DUI Case:

  1. The Arrest
  2. Since you've already been through this, it doesn't need much explaining. But if the police made mistakes in your arrest or in the events leading up to it (for example, did they have good reason to pull you over?), it could lead to dismissal of your charges.

  3. Booking and Bail
  4. "Booking" is when the police take your fingerprints, mug shots and other personal information at the station. "Bail" describes the process where the police release you after you pay a certain amount of money and agree to be present at your scheduled court appearances.

  5. Arraignment
  6. "Arraignment" is where you appear in court briefly to have your charges read to you and to enter your "guilty" or "not guilty" plea to the charges. If you plead guilty, your case will go no further.

  7. Plea Bargain
  8. You may be able to plea your charges down to something more manageable – like "open container" or "reckless driving" – if you agree to plead guilty in return. Never accept a plea bargain that isn't in your best interest!

  9. Preliminary Hearing
  10. Here, the judge views all the evidence and may hear from witnesses to decide whether or not the prosecution's case is strong enough to warrant holding a trial.

  11. Pretrial Motion
  12. This is a phase where the defense and prosecution can make arguments over what evidence should and should not be admissible during the trial.

  13. Trial
  14. Based on the admissible evidence, your attorney and the prosecutor will make arguments as to whether or not you are guilty beyond a reasonable doubt.

  15. Sentencing
  16. In New Jersey, a guilty sentence can mean time in jail, plus exorbitant fines and suspended license.

  17. Appeals
  18. If you believe the judge has erred or delivered an unfair sentence, you can appeal that decision to a higher court.
